The employer was granted an extension of time to appeal a January 28, 2020 decision of the Appeals Resolution Officer allowing initial entitlement. The notice of appeal was filed on February 12, 2021. Limitation periods were suspended from March 16, 2020 to September 11, 2020 due to the COVID-19 situation, which meant that the length of delay in appealing was approximately one month. This would not be expected to affect the Tribunal's ability to adjudicate the appeal. In addition, the suspension of limitation periods added a level of complexity to the calculation of time limits once they were reinstated, and contributed to the employer's delay in appealing.
