Highlights of Noteworthy Decisions

Decision 99 13
2013-04-10
B. Kalvin - V. Phillips - D. Broadbent
  • Harassment (sex)
  • Stress, mental

The worker had entitlement for traumatic mental stress. She was harassed by her supervisor over a two-month period during which time the supervisor repeatedly made inappropriate sexual remarks, on one occasion suggested that they go to a motel, and tried to kiss her when they were working offsite. The Vice-Chair noted that harassment by the supervisor made the worker's ability to take evasive and remedial steps more difficult and risky, and that the attempts to kiss the worker while offsite constituted a threat to personal security.
